Nintendo has filed a lawsuit against the U.S. government, contesting the legality of tariffs imposed on imported products during President Donald Trump’s administration. Filed on March 6, 2026, in the U.S. Court of International Trade, the lawsuit requests a refund of tariffs paid under trade policies enacted during Trump’s presidency. According to an Aftermath website report, this legal action is an unusual move for the video game industry, as few expected Nintendo to challenge the tariffs directly in federal court. Nintendo argues that these tariffs—referred to as IEEPA duties in legal documents—were illegally enforced through executive orders signed by Trump beginning in February 2025. The company states that these measures affected imports from various countries and generated significant additional costs for companies reliant on the global hardware manufacturing chain.

The lawsuit targets several U.S. government officials, including Treasury Secretary Scott Bessent, former Interior Secretary Kristi Noem, U.S. Trade Representative Jamieson Greer, Customs and Border Protection Commissioner Rodney Scott, and Commerce Secretary Howard Lutnick. Nintendo asserts its right to sue, claiming it is a registered importer of products subject to these tariffs. The company seeks to recover the money paid to the U.S. Treasury Department, Homeland Security, and Customs and Border Protection due to the Trump-era tariffs, which Nintendo notes the Supreme Court had deemed illegal. Nintendo’s lawsuit includes the statement that it cannot guarantee the recovery of these funds without legal action. On April 3, 2026, U.S. Customs and Border Protection informed the Court of International Trade that technical limitations prevent it from complying with the order to refund the tariffs. Nintendo claims it has already suffered damages and is at risk of further losses if the court does not compel the government to return the funds with interest. As such, Nintendo demands the government return all payments made under the IEEPA duties, plus interest.

Lawsuit Over Nintendo Switch 2 Tariffs: Impact on Future Product Pricing

The lawsuit emerged nearly a year after the government announced the tariffs. In April 2025, Nintendo officially revealed the Nintendo Switch 2, coinciding with President Trump’s announcement of increased global tariffs. At that time, Nintendo postponed the opening of pre-orders for the device in the U.S. and later confirmed price increases for some accessories when reservations finally became available. This legal action raises concerns that similar tariffs could impact the pricing of future Nintendo products. The effects of the tariffs were previously felt in the American market when the price of the original Nintendo Switch was adjusted. While Nintendo cited various factors contributing to the increase, analysts suggested that trade tariffs were among the elements that increased production and distribution costs. Industry executives have since warned that the new Switch 2 could also face similar adjustments, particularly given current difficulties related to memory supply and electronic components. Currently, neither Nintendo nor U.S. government authorities have released further comments on the ongoing legal process.
