Nintendo has filed a lawsuit in U.S. courts against the U.S. government, seeking a refund for tariffs paid over the past year. According to a report on Aftermath, the lawsuit was filed on March 6, 2026, with the United States International Trade Commission. The suit names the following individuals as key defendants: Scott Bessent, Treasury Secretary Kristi Noem, former Department of Homeland Security Secretary Jamieson Greer, U.S. Trade Representative Rodney Scott, Customs and Border Protection Commissioner Howard Lutnick, Commerce Secretary The lawsuit addresses import duties introduced by the Trump administration beginning February 1, 2025, through executive orders targeting various countries. Nintendo, along with over a thousand other businesses, seeks a return of these tariffs, which the U.S. Supreme Court ruled illegal in 2025. Nintendo of America now demands financial compensation for the impact of these tariffs on its hardware sales. Nintendo is challenging the tariffs as unlawful under the International Emergency Economic Powers Act of 1977 (IEEPA). Citing the Supreme Court’s 2025 ruling, Nintendo argues that the tariffs violate IEEPA and that, as an importer subject to IEEPA commissions, it has grounds to legally pursue refunds, including the money paid, interest, and court expenses.
